Recently, the Intellectual Property Office of Jiangsu Province and Jiangsu Provincial Department of Industry and Information Technology jointly issued the Implementation Plan for the Pilot Program on Data Intellectual Property in the Industrial and Information Technology Sector of Jiangsu Province. Focusing on three major pilot tasks, namely improving the registration system, building a service ecosystem, and enhancing the quality and efficiency of application, it outlines 20 innovative measures. The Plan proposes that by June 2026, the data intellectual property registration, protection, and application system should be basically established, with application scenarios such as licensing and transactions, securitization, valuation for equity participation, and data asset inclusion in balance sheets fully implemented.
This pilot program aims to comprehensively deepen the reform of data IPR, ensuring better protection of data IPR in line with high standard to incentivize the supply of high-quality data, activate efficient and high-value data circulation and application, and promote data-empowered new industrialization in an all-round way.
The Plan specifies that efforts will be made to further deepen prudent review of data intellectual property rights, conduct researches and introduce policy measures to encourage registration and application, to give more enterprises confidence that they are willing to register and follow the proper procedure. A group of professional data IPR service agencies will be cultivated, and the development of a protection system integrating judicial, arbitration, and mediation services will be accelerated, aiming to ensure comprehensive protection for data IPRs, including IP mining, registration, commercialization, application, and protection. Local authorities are encouraged to explore application scenarios such as data IP licensing and transactions, credit enhancement financing, valuation for equity participation, and data asset inclusion in balance sheets, to accelerate the growth of data-driven emerging and future industries.
